Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents more particularly to direct the 3rd respondent to issue birth certificate changing the petitioner daughters name as M.Nivetha by removing the earlier name as Niranjani in consideration of the Tamil Nadu Government Gazette dated 14.08.2024 and consequently considering the petitioners representation dated 07.10.2025 and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the

case and thus render justice.

ORDER

The above writ petition has been filed for the following relief:-

“Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents more particularly to direct the 3rd respondent to issue birth certificate changing the petitioner daughters name as M.Nivetha by removing the earlier name as Niranjani in consideration of the Tamil Nadu Government Gazette dated 14.08.2024 and consequently considering the petitioners representation dated 07.10.2025 and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.”

2. Mrs.D.Farjana Ghoushia, learned Special Government Pleader takes notice on behalf of the 1st respondent. Mr.J.Lawrence, learned Standing Counsel takes notice on behalf of the respondents 2 and 3. 3. By consent of both the parties, the writ petition is taken up for final disposal at the admission stage itself.

4. The case of the petitioner is that her daughter namely Niranjani was born in the year 18.04.2024 and she has also obtained birth certificate in the name of her daughter. Thereafter, she and her husband decided to change the name of their daughter from M.Niranjani to M.Nivetha according to numerology and they have also published the same in Tamil Nadu Government Gazette dated 14.08.2024 with effect from 05.08.2024.

5. In this connection, the petitioner had requested the 3rd respondent to issue a fresh birth certificate to her daughter in the name of M.Nivetha, however, the 3rd respondent had rejected the request made by the petitioner.

6. Therefore, the petitioner had sent a detailed representation dated

07.10.2025 along with the Tamil Nadu Government Gazette dated 14.08.2024 to the respondents, requesting them to issue fresh birth certificate to her daughter. However, no action has been taken to date.

Aggrieved by the same, the petitioner is before this Court.

7. The learned Special Government Pleader appearing for the

1st respondent would submit that the representation submitted by the petitioner dated 07.10.2025, will be considered and orders will be passed within the time stipulated by this Court.

8. In view of the same, without expressing any opinion on the merits of the matter, the 1st respondent is directed to consider the representation of the petitioner dated 07.10.2025 and pass appropriate orders on merits and in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order.

9. The writ petition stands disposed of with the above observations.
