PRAYER :- This Petition is filed under section 528 BNSS, to call for the records relating to the Charge Sheet in S.C.No.153 of 2025 on the file of the Principal District and Sessions Court, Kanniyakumari at Nagercoil

and quash the same as far as the petitioner is concerned.

ORDER

The petitioner seeks to quash the impugned final report filed for the offences under Sections 109, 296(b), 303(2), 329 (4), 64 and 74 BNS.

The gist of the allegation is that the petitioner and the defacto complainant had extramarital relationship; that when the defacto complainant severed that relationship, the petitioner attacked the defacto complainant and her husband with hands and caused grievous injuries and thus committed the aforesaid offences.

3. Admittedly, the petitioner, the second respondent and the victim belong to same village and they have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 14.11.2025.

4. The petitioner and the defacto complainant are present before this Court in person. They are identified by Mr.G.Rajkumar, Special Sub Inspector of Police, Nithravilai Police Station, Kanyakumari District.

All the parties confirmed the compromise arrived at between them.

5. Though the petitioner has been charged for the offence under Section 109 BNS, it is seen that the attack is said to have been made with hands and the allegations, at best would only disclose the offence under Section 326 IPC (118(2) BNS).

6. The parties have since arrived at a compromise and the petitioner had undertaken that he would not disturb the defacto complainant in future. The defacto complainant does not wish to pursue the case. Considering the aforesaid facts, this Court is of the view that no useful purpose would be served by keeping the impugned final report pending trial. Accordingly, the impugned final report is quashed and the Criminal Original Petition stands allowed. The joint compromise memo dated 14.11.2025, shall form part and parcel of the order. The petitioner shall pay a cost of Rs.10,000/- to the Mediation and Conciliation Centre attached to this Bench and file a photocopy of the receipt along with a memo reporting compliance in the Registry. Consequently, connected Miscellaneous Petition is closed.
