Prayer: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned proceedings of the 2nd respondent passed in Document No.5226/2024 dated 29.04.2025, demanding the Petitioner to pay Additional Stamp Duty and Registration Charges to the tune of Rs.10,48,000/- and the subsequent Impugned Proceedings of the 2nd
Respondent passed in Document No.5226/2024 dated 01.08.2025 Demanding the Petitioner to pay Additional Stamp Duty and Registration Charges to the tune of Rs.10,45,452/- and consequentially direct the 2nd respondent to return the Original Document in Doc No.
5226 of 2024 to the petitioner.

ORDER
Heard both sides.
2.The petitioner had purchased the petition mentioned property at a SARFAEASI auction sale. Sale certificate was also issued. The same was also presented for registration. The registering officer has declined to release the document on the ground that there is under valuation. My attention is drawn to the order dated 23.09.2025 made in WP(MD)No.1064 2025. Following the earlier Division Bench decision reported in (2024) 4 MLJ 754 (Vijayalakshmi Marketting, Partnership Firmv. State of Tamil Nadu), I had held that the market value set out in sale certificate shall be accepted as such by the second respondent. The question of invoking Section 47A of the Indian Stamp Act does not arise at all.
3.In this view of the mater, the impugned refusal check slip is quashed. The second respondent is directed to register the document in question, release the same to the petitioner subject to the other usual formalities. This writ petition is allowed. No costs. Connected miscellaneous petition is closed.
