PRAYER This writ petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the respondents to consider the representation of the petitioners dated 2.9.2025 in the light of the orders passed in WP No.6037/2024 dated 7.3.2024 regarding allotment of houses to the petitioners, who have been originally residing at 2^nd respondent’s Pulianthope Housing Board sites, migrated from Pulianthope to Vyasarpadi under the assurance of providing alternative residential houses, within a time frame to be filed by this Hon’ble Court.

ORDER

This writ petition is filed seeking of a direction to the respondents to consider the representation of the petitioners dated 02.9.2025 in the light of the orders passed in WP No.6037/2024 dated 7.3.2024 regarding allotment of houses to the petitioners, who have been originally residing at 2^nd respondent’s Pulianthope Housing Board sites, migrated from Pulianthope to Vyasarpadi under the assurance of providing alternative residential houses, within a time frame to be filed by this Court.

2.The learned counsel for the petitioners would submit that the petitioners are slum dwellers, who originally were residing at Pulianthope Slum Area, which belongs to the second respondent. The second respondent evicted the petitioners from the Pulianthope Slum Area after giving assurance to them that they will be given reallotment in the same Pulianthope area after construction of flats by the second respondent and the petitioners are currently residing at Vyasarpadi, in a place which also belongs to the 2^nd respondent. However, the second respondent is now taking steps to evict the petitioners from the present place ie., Vyasarpadi. Therefore, the petitioners had given a representation to the respondents on 02.09.2025 seeking for alternate site/flat. However, the same is yet to be considered. Hence, the present writ petition.

3.Per contra, the learned Standing Counsel for the Tamil Nadu Urban Habitat Development Board would submit that out of the 50 applications filed by the petitioners, 27 applications have already been considered and that since remaining 23 applicants did not submit the proof of occupation, the same could not be considered. He would however, submit that the remaining applications will be considered within a time frame as fixed by this Court.

4.Heard both sides and perused the materials available on record.

5.Considering the facts and circumstances of the case, the second respondent is now directed to consider the remaining 23 applications of the petitioners, and to pass appropriate orders, after providing an opportunity of hearing to the petitioners, within a period of eight (8) weeks from the date of receipt of a copy of this order.

6.The writ petition is disposed of accordingly. No costs. Consequently, the connected miscellaneous petition is closed.
