ORDER

This Criminal Original Petition has been filed by minor represented by his natural guardian/father seeking to quash J.C.No.193 of 2025 on the file of the Juvenile Justice Board, Coimbatore.

2.The case of the prosecution as per the de facto complainant – Gomathi is that on 17.05.2025, her son and the juvenile in conflict with law were playing Cricket by forming two groups; the team of the juvenile in conflict with law lost the match and hence, her son told the juvenile in conflict with law that he is a loser; enraged by the same, the juvenile in conflict with law had assaulted her minor son with a Cricket bat resulting in him sustaining injuries; the juvenile in conflict with law had also threatened the petitioner’s minor son that he would kill him.

3.Hence, based on a complaint given by the second respondent, a case in Cr.No.271 of 2025 was registered for the offences under Sections 118(1) and 351(3) of the BNS, 2023. The first respondent police, after completing the investigation, filed a final report before the Juvenile Justice Board for offences under Sections 118(1) and 351(3), ibid. and the case was taken up as J.C. No.193 of 2025. Seeking quashment of the same on the ground of compromise, this criminal original petition has been filed.

4.The learned counsel for the petitioner would submit that the juvenile in conflict with law and the second respondent/de facto complainant’s son (minor victim) were residents of the same apartment complex; while so, a quarrel had ensued while they were playing Cricket match; the team of the juvenile in conflict with law lost the match and the minor victim teased him saying that he is a loser and the incident happened as a consequence of that; later, due to the intervention of the parents of the juvenile in conflict with law and well wishers in the apartment complex and taking into consideration the future of the juvenile in conflict with law and also the minor victim, the petitioners’ parents and the de facto complainant have compromised the matter amongst themselves and hence, the impugned proceedings against the petitioner may be quashed. The learned counsel would further submit that the parents of the juvenile in conflict with law have filed an apology dated 26.11.2025 expressing their remorse for the act of the juvenile in conflict with law.

5.The petitioner and his parents are present and the de facto complainant/R2 Gomathi appeared through video conferencing and they were identified by their respective counsel as well as by Mr.P.Sankar, Gr.II, PC 2383, C2 Race Course Police Station, Coimbatore City.

6.On being enquired by this Court, the de facto complainant stated that she has amicably settled the dispute with the petitioner and she is not willing to pursue the criminal proceedings and therefore, seeks to quash the same.

7. The learned Additional Public Prosecutor appearing on behalf of the first respondent submitted that though the parties have entered into a compromise
