ORDER

This Writ Petition has been filed challenging the order dated

14.05.2025 on the file of the third respondent thereby rejected the request made by the petitioner seeking promotion on par with his batch mate.

2. The petitioner applied for the post of Grate II Police Constable.

After successfully completing written and physical efficiency tests, the petitioner’s candidature itself was rejected on the ground that the petitioner had suppressed the fact that he was involved in a criminal case, which was challenged before this Court in W.P.No.13755 of 2020. This Court allowed the writ petition and directed the respondents to appoint the petitioner for the post of Grade II Police Constable on condition that the petitioner shall not claim any seniority benefits on par with his batch mates as per the provisional selection list. As directed by this Court, the petitioner had given an undertaking that the he will not claim any seniority benefits on par with his batch mates. Even then, the petitioner submitted representation seeking seniority on par with his batch mates.

3. In view of the specific directions issued by this Court, the request made by the petitioner was rightly rejected by the third respondent. Once the petitioner had undertaken not to claim any seniority on par with his bath mates, he is estopped from seeking any promotion on par with his batch mates. Therefore, this Court finds no infirmity or illegality in the order passed by the third respondent. The writ petition is devoid of merits and hence, it is dismissed. Consequently, WMP No.45143 of 2025 is closed.
