Writ petition is filed under Article 226 of the Constitution of India seeking for issuance of writ of certiorarified mandamus to call for the entire records relating to the impugned order passed by the 2nd respondent in 2025/N103/10/036156, dated 06.12.2025 and quash the same and consequentially direct the respondents to name transfer of the patta from Thirumoorthy son of Palaniyappa Nadar to the name of the petitioner pertaining to the land comprised in S.No.637/3, Punjai Kilampadi Village, Kodumudi Taluk, Erode Taluk and District, considering the petitioner’s application dated

06.12.2025.

ORDER

This writ petition has been filed challenging the impugned order dated

06.12.2025 passed by the second respondent rejecting the petitioner’s application seeking for issuance of patta for the property morefully described in the prayer to this writ petition, on the ground that the impugned order is a non-

speaking order.

2. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents.

3. As seen from the impugned order, except for stating that the petitioner’s application has been rejected on account of objections from the legal heirs, the second respondent has not disclosed the details of the legal heirs who have objected to the petitioner’s application.

4. The petitioner claims that he is the absolute owner of the property having purchased the same under a registered sale deed of the year 2011. The petitioner also contends that reasons given by the second respondent in the impugned order, namely, “objection for legal heirs” is arbitrary and illegal and without any basis. The impugned order dated 06.12.2025 is certainly a non- speaking order. Being a non-speaking order with regard to the contentions of the petitioner as raised in this writ petition, which are supported by documents, necessarily, the impugned order has to be quashed and the matter remanded back to the second respondent for fresh consideration.

Accordingly, the impugned order dated 06.12.2025 passed by the second respondent is hereby quashed by this Court and the matter is remanded back to the second respondent for fresh consideration on merits and in accordance with law, after affording sufficient opportunity to the petitioner to produce all the relevant documents in support of the application seeking for issuance of patta for the subject property. The second respondent is directed to complete the aforesaid exercise within a period of 12 weeks from the date of receipt of a copy of this order. With the aforesaid directions, this writ petition is disposed of. No Costs. W.M.P.No.1184 of 2026 is ordered.
