ORDER
The Writ Petition has been filed seeking to quash the impugned notice issued by the second respondent dated 08.12.2025, and consequently, to direct the respondents 1 and 2 to refer the parties to the competent civil court, without conducting any proceedings in respect of the survey of the land in Survey No.
3144/1B at Genguvarpatty Village, Periyakulam Taluk, Theni District.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. Since no adverse orders are going to be passed against the third respondent, notice to the third respondent is hereby dispensed with.

The learned counsel appearing for the petitioner submits that the petitioner’s father was granted Patta bearing No.2319 in respect of Survey No. 3144/1, measuring 1.11 ares (i.e., 2.75 cents), at Genguvarpatty Village, Periyakulam Taluk, Theni District. Thereafter, on 19.06.2025, the petitioner received a notice to survey the said land, based on an application submitted by the third respondent herein. On receiving the notice, the petitioner verified the revenue records and came to know that the third respondent, with the assistance of her husband, had allegedly created forged documents and effected mutation of the Patta in her name. On the strength of the same, the third respondent is attempting to evict the petitioner and his family from the subject property. Hence, the petitioner submitted a representation dated 13.10.2025 to the Revenue Divisional Officer, Periyakulam, requesting that the Patta in the name of the third respondent be cancelled. In the meanwhile, the respondents 1 and 2 issued the notice to survey the land in Survey No.3144/1B, which is the subject matter of the present Writ Petition.
5. The learned Government Advocate appearing for the respondents 1 and 2 submits that an enquiry will be conducted and, after hearing the petitioner and the third respondent, appropriate orders will be passed on merits and in accordance with law.

Recording the above submissions, and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the respondents 1 and 2 to conduct an enquiry in respect of the application made by the third respondent for the survey of the land. After hearing the petitioner, the third respondent, and any other persons who may be affected, the respondents 1 and 2 shall pass appropriate orders on merits and in accordance with law. Such orders shall be passed after providing a reasonable opportunity of hearing to all concerned, within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.
