ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent to pass final orders on the petitioner’s appeal dated 27.12.2023, seeking cancellation of the patta issued in the name of the deceased husband of the third respondent herein, the eighth respondent herein and deceased father of the ninth respondent, and to transfer the patta for the land in Survey No. 49/7B, admeasuring 31 cents, situated at Neduvasal Mel Pathi, Keeramangalam Circle, Alangudi Taluk, Pudhukottai District, in the petitioner’s name.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the respondents 3 to 9, notice to the respondents 3 to 9 is hereby dispensed with.

4. The learned counsel appearing for the petitioner would submit that the petitioner is the lawful owner of the property in Survey No.49/7B, admeasuring 31 cents, situated at Neduvasal Mel Pathi, Keeramangalam Circle, Alangudi Taluk, Pudhukottai District. A patta has been erroneously issued in the name of the deceased husband of the third respondent herein, the eighth respondent herein and deceased father of the ninth respondent, despite the petitioner’s lawful entitlement. Hence, the petitioner filed an appeal dated 27.12.2023 requesting cancellation of the erroneous patta and transfer of the patta in his name. No orders have been passed on the petitioner’s appeal, and the delay in disposal is arbitrary, unreasonable, and prejudicial to the petitioner’s rights. Hence, the present Writ Petition.

5. The learned Government Advocate appearing for the respondents 1 and 2 would submit that the petitioner's appeal will be considered and appropriate orders will be passed on merits and in accordance with law within a time frame to be fixed by this Court.

6. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's appeal dated 27.12.2023, on merits and in accordance with law and pass appropriate orders after providing reasonable opportunity of hearing to the petitioner, the respondents 3 to 9 and any other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
