O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to rectify the error in the UDR patta (Patta No.429) relating to the property at Karachuthupudur Village, Thisayanvilai Taluk, Tirunelveli District, as per the registered sale deed dated 13.07.1984 in Doc.No.595 of 1984, by considering the petitioner’s representations dated 29.12.2025 and 31.12.2025, within a time frame to be fixed by this Court.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The grievance of the petitioner is that he purchased the land in Survey No.538/1, measuring an extent of 8 cents, situated at Karachuthupudur Village, Thisayanvilai Taluk, Tirunelveli District, vide a registered sale deed dated 13.07.1984 bearing Document No.595 of 1984.
During the UDR survey and revenue sub-division, the petitioner’s land was reflected under UDR Patta No.429 and subdivided into Natham Survey No.537/1B1H, measuring 2.14 ares, Survey No.538/2A1, measuring 0.13 ares, and Survey No.538/8, measuring 0.69 ares.
4. The petitioner’s residential house is situated entirely within Natham Survey No.537/1B1H, which approximately corresponds to 5 cents. However, the third respondent, without proper verification, issued a notice dated 15.09.2025 stating that the petitioner’s compound wall had encroached upon land in Survey No.537/1B1I, measuring an extent of 1.37 ares, which is classified as ‘Poosthiti Paadhai’ (landed pathway) and directed removal of the same.
5. Upon verification of the FMB and revenue records pertaining to UDR Patta No.429, the petitioner found that Survey No.538/2A1 and Survey No.538/8 are reflected as being situated about 500 metres away from the petitioner’s residential house. Upon noticing the said errors, the petitioner submitted an explanation to the third respondent, who instructed the petitioner to file a survey application. Pursuant thereto, the petitioner submitted a survey application dated 10.11.2025 before the fourth respondent. However, till date, no action has been taken to conduct the survey.
6. Further, the petitioner submitted representations dated
29.12.2025 and 31.12.2025 to the first and second respondents. All the representations remain pending. Despite the same, the third and fourth respondents are attempting to demolish the petitioner’s compound wall on the basis of erroneous UDR sub-divisions. Therefore, the petitioner has filed the present writ petition.
7. The learned Government Advocate appearing for the respondents would submit that the petitioner's representations dated 29.12.2025 and 31.12.2025 would be considered and appropriate orders would be passed within a period of eight weeks.
8. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first and second respondents to consider the petitioner’s representations dated 2
