Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of writ of certiorarified mandamus, calling for the records relating to the impugned proceedings issued by the 3rd respondent in Na.Ka.
No.65778/C5 / E2/2025 dated 08.12.2025, quash the same in so far as declaring the petitioner as not eligible for promotion to the post of Physical Director Grade II is concerned, and consequently direct the respondents to include the name of the petitioner in the 2025 panel and to promote the Petitioner as Physical Director Grade II by treating the BPES degree awarded by Annamalai University as an eligible qualification based on panel seniority with consequential benefits.

ORDER
This Writ Petition has been filed challenging the impugned proceedings issued by the 3rd respondent in Na.Ka. No.65778/C5 / E2/2025 dated 08.12.2025, quash the same in so far as declaring the petitioner as not eligible for promotion to the post of Physical Director Grade II is concerned, and consequently direct the respondents to include the name of the petitioner in the 2025 panel and to promote the Petitioner as Physical Director Grade II by treating the BPES degree awarded by Annamalai University as an eligible qualification based on panel seniority with consequential benefits.
2. By the consent of the learned counsel appearing on either side, this writ petition is taken up for disposal at the admission stage.
3. Learned Senior Counsel appearing for the petitioner would submit that the petitioner has been working as Physical Education Teacher in Government Higher Secondary School, Sathiyamurthi Nagar, Avadi, Tiruvallur District and the next level of promotion is Physical Director Grade II. However, the petitioner’s promotion is delayed because of non-obtaining Bachelor of Physical Education (B.P.Ed.,) qualification.

Learned senior counsel appearing for the petitioner would submit that the petitioner has acquired the required qualification to the promotional post of Physical Director Grade-II by acquiring BPES qualification, which is equivalent to B.P.Ed. and without considering the same, the respondent rejected promotion to the petitioner for the said post. The petitioner has already made an objection on 11.12.2025 to the Head Master and one the same day, the said objection was recommended by the Headmaster to the 4th respondent. However, till date, the 4th respondent has not considered the same. Hence, he prayed for appropriate orders.
5. Learned Senior counsel appearing for the petitioner would submit that this Court may issue a direction to the respondents to consider the petitioner’s objection dated 11.12.2025 and pass appropriate orders on the same within a specified time.
6. Learned Special Government Pleader appearing for the respondents would submit that the respondents will consider the petitioner’s objection dated
11.12.2025 and pass appropriate orders within a period of six weeks.
7. In view of the same, the 4th & 2nd respondents are directed to consider the petitioner’s objection dated 11.12.2025 which was recommended by the
