COMMON ORDER

W.P.No.50177 of 2025 has been filed seeking a direction to the 3rd respondent Municipality to allot Shop No.9 in the ground floor to the petitioner herein in the newly renovated western wing of Anna Thidal Smart city building as per undertaking given by the 3rd respondent Municipality vide its proceedings No.3317/ Pu. Na/ Va.A-2/ A.4/ 2020 dated 17.03.2021.

2. W.P.No.50186 of 2025 has been filed seeking a direction to the 3rd respondent Municipality to forthwith allot and hand over possession of a shop to the petitioner in the very same and original location where the petitioner’s shop was situated prior to his vacation on the ground floor of the newly renovated western wing of the Anna Thidal Smart City Building, strictly in accordance with the undertaking given by the 3rd respondent municipality vide its proceedings No.3317/ Pu. Na/ Va.A-2/ A.4/ 2020 dated 09.03.2021.

3. The petitioners were eking out their living in Anna Thindal, Puducherry. They were vending their goods by having bunk shops in the said area. The Puducherry Municipality decided to modernise the area by availing the Smart City Scheme introduced by the Government of Puducherrry. The petitioners had vacated the area. New shops have been constructed to accommodate the persons who had earlier vacated the premises.

4. The grievance of the petitioners is that they are not been allotted shops in the new shopping complex constructed by the respondents.

5. Ms.Usha learned counsel representing the respondents states that an association had been formed by the vendors like the petitioners under the name of ‘Goubert Bazaar Small Vendors Association’. The said Association had requested that the shops have been constructed be allotted in Seriatim . The Commissioner, Puducherry Municipality has accepted the request of the Association and had filed an
