2. The petitioner claims that after retirement, he was suffering with several ailments and his wife had also filed a suit before the District Munsif Court in O.S.No.379 of 2014 as against the respondents seeking disbursement of retirement benefits. The suit was settled in the Lok Adalat and a decree has also been passed in the Lok Adalat. Even thereafter, his retirement benefits have not been granted. Therefore, the petitioner is before this Court.
3. Mr.P.Gunasekaran, learned Standing Counsel, takes notice for the first respondent. Mr.M.Sarangan, learned Additional Government Pleader, takes notice for the respondents 2 to 4.
4. The learned counsel for the respondents submitted that the petitioner borrowed several loans and absconded. Therefore, he was not available for receiving the amount. The DCRG amount and other amounts have already been sanctioned to the petitioner on 24.06.2014. However, the petitioner has not claimed the same and therefore, it has been lapsed.
5. This Court considered the rival submissions made.
6. Admittedly, the petitioner was allowed to retire from service in the year 2013 and therefore, he is eligible for the retirement benefits. The petitioner claims that he is a disabled person and he was suffering with several ailments, therefore, he was not in a position to follow up the same. The petitioner's wife has also filed a suit before the District Munsif Court, Madurai, in O.S.No.379 of 2014 as against the respondents seeking disbursement of retirement benefits and a decree has also been passed in the Lok Adalat.
