Application filed under Order XIV Rule 8 of Original Side Rules r/w Section 307 of Indian Succession Act to permit the Petitioners to sell the property morefully described in the Schedule in the O.P.No.207 of 2022 and mentioned hereunder in the Schedule.

O R D E R
This application has been filed by the applicants to permit them to sell the schedule mentioned property in the Original Petition.
2. According to the applicants, already they filed the main original petition in O.P.No.207 of 2022 for grant of Letters of Administration and the same was allowed by an order of this Court dated 22.12.2023. Now, the applicants intend to sell the property, as the same is not possible for enjoyment of the property in common, since it is a residential flat. The applicants also identified intending purchasers in order to sell the property and to share the sale proceeds among themselves. Therefore, the applicants filed this application to permit them to sell the property to the intending purchasers.
3. There is no respondent in this application. On the side of the applicants, they examined, 6th applicant, viz., Venkatasubramanian Nagarajan, as P.W.1 and also marked Exhibit Ex.A.1.
4. On a careful perusal of evidence of P.W.1 and Exhibit A.1, it is clear that already this Court granted Letters of Administration in favour of the applicants and now, the applicants have decided to sell the property to the intending purchasers to the tune of Rs.1,10,00,000/- [Rupees One Crore and Ten Lakhs only] and the applicants are the legal heirs of the deceased Lakshminarayanan, who is the original owner of the property and died intestate on 12.11.2020. The applicants being legal heirs of the said Lakshminarayanan, are equally entitled to the Original Petition mentioned property and the applicants have amply proved their case, therefore, it is appropriate to allow this application.
