This writ petition is filed under Article 226 of Constitution of India, to PRAYER;

issue a Writ of Mandamus, directing the respondents (i)to sanction family pension to the 1st petitioner with effect from the date of death of her mother on 4.3.2018 (ii) to pay the arrears of family pension with interest at the rate of 12 percentage p.a to the 1st petitioner (iii)to pay the Death cum Retirement Gratuity and provident fund with interest at the rate of 12 percentage pa to the 1st petitioner (iv)to pay all other consequential pension benefits to the petitioner For Petitioner(s): Mr.R.Prem Narayan For Respondent: Mr.C.Selvaraj, AGP ORDER This petition has been filed seeking a direction to the respondents (i)to sanction family pension to the 1st petitioner with effect from the date of death of her mother on 4.3.2018 (ii) to pay the arrears of family pension with interest at the rate of 12 percentage p.a to the 1st petitioner (iii)to pay the Death cum Retirement Gratuity and provident fund with interest at the rate of 12 percentage pa to the 1st petitioner (iv)to pay all other consequential pension benefits to the petitioner.

2. It is the case of the petitioner that the petitioner's mother was working as Sanitary Supervisor in the Attur Municipality and had died while she was in service on 04.03.2018 leaving behind the petitioner and her yonger sister as legal heirs. The petitioner is unmarried. As per GO.Ms.No.325 the petitioner is entitled for family pension and her younger sister had given her consent to give the petitioner full family pension. The family pension proposal of the petitioner was returned by the 3rd respondent in proceeding dated 17.09.2021. In proceeding dated 18.03.2025, the 4th respondent had submitted a proposal to the first and second respondent to approve the regularisation of the petitioner's mother from 15.06.1998. Despite the directions issued by this Court to regularise the services of the petitioner's mother from 15.06.1998, the third respondent has returned the family pension proposal by insisting on Government Orders regularising the services of the petitioner's mother. Hence the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Additional Government Pleader appearing for the respondents submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the first respondent to consider and pass orders on the petitioner's representation dated 18.03.2025 within a period of four weeks from the date of receipt of a copy of this order.

7. With the above directions, the writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs.
