O R D E R

This Writ Petition has been filed seeking a direction to the 1^st respondent to enhance and pay subsistence allowance at the rate of 75 % instead of 50 %, in accordance with Rule 3 (1) of The Tamil Nadu Payment of Subsistence Allowance Act, 1981 with effect from 03.11.2022, by considering and disposing of the petitioner’s representation dated

24.09.2025.

2.The case of the petitioner is that he worked in the SIPCOT, Sriperumbudur Expansion Scheme as Special District Revenue Officer (Land Acquisition) from 11.09.2018 to 08.09.2018. After that, he was transferred and appointed as District Revenue Officer (Temple Lands) in HR & CE Department on 18.11.2021 vide Government Order No.4485/ Public (Special-A) Department, pursuant to which, he worked from 26.04.2022. He was temporarily suspended from service by G.O (2D) No.61, Public (Special-A) Department dated 12.08.2022 on the allegation that, while working as Special District Revenue Officer (Land Acquisition), SIPCOT, Vallam – Vadgal Scheme Sriperumbudur, he disbursed compensation to the land owners whose lands were acquired by passing awards in respect of OSR lands and paid compensation to such land owners. On 20.09.2022, he was permitted to receive subsistence allowance as admissible under rule 53(1) of Fundamental Rules, and accordingly, he has been receiving subsistence allowance at the rate of 50%. The petitioner made a representation to the 1^st respondent on 24.09.2025 seeking payment of subsistence allowance at the rate of 75% instead of 50%, as provided under Rule 3(1) of The Tamil Nadu Payment of Subsistence Allowance Act 1981 from 03.11.2022, However, till date, the 1^st respondent has not initiated any action on the said representation.

Hence, the present writ petition has been filed.

3.The learned counsel for the petitioner would submit that it would suffice, if a direction is issued to the 4^th respondent to consider the petitioner's representation within a reasonable time.

4.The learned Additional Government Pleader appearing for the 4th respondent would submit that they will consider the petitioner's representation and pass appropriate orders within a reasonable time to be fixed by this Court.

5.Considering the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the 4th respondent to consider the petitioner’s representation dated 24.09.2025 on merits and in accordance with law and pass appropriate orders, within a period of six (6) weeks from the date of receipt of a copy of this order, 6.With the above directions, this writ petition is disposed of. No costs.
