ORDER

This writ petition has been filed for a mandamus forbearing the 3rd respondent herein from interfering with the Hereditary Trusteeship rights of the Petitioners in Arulmighu Nachiarammal Trust, Vandiyur, Madurai District pursuant to the Order of stay passed by the 1st respondent dated

15.12.2025 in M.P.No.1 of 2025 in R.P.No.561 of 2025.

2. Heard the learned counsel for the petitioners, learned Special Government Pleader for the official respondents and the learned counsel for the private respondent. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.

3. The learned counsel for the petitioners would submit that in spite of the first respondent staying the order passed by the 2nd respondent, for appointing the third respondent as a fit person vide order dated 15.12.2025, the third respondent is still interfering with the affairs of the Trust. Therefore, he prays for appropriate direction.

4. The learned counsel for the third respondent would submit that the revision was posted on 05.01.2026 before the Commissioner and now the same stood adjourned to 02.02.2026. Therefore, he would submit that until the vacation of the stay granted by the Commissioner, they will not interfere with the affairs of the Trust. The said submission is recorded.

5. Recording the said submission, the third respondent is directed to not to interfere with the affairs of the Trust unless and until the stay granted by the Commissioner dated 05.01.2026 stands vacated or the disposal of the revision in favour of the third respondent. The first respondent is directed to dispose of the revision within a period of three months from the date of receipt of a copy of this order.

4. With the aforesaid direction, the writ petition is disposed of. No costs. Consequently connected Miscellaneous Petitions are closed.
