PRAYER: Criminal Revision filed under Sections 438 r/w 442 Cr.P.C. and 397 r/w 401 to set aside the order in Crl.MP.No.592/2025 in CC.No.100/2024 (Hon’ble District Munsif Cum Judicial Magistrate Court, Thiruporur) set aside the impugned order and consequently allow the petitioner application filed under Section 143A of the Negotiable Instrument Act 1881, directing the Respondent/accused to pay interim compensation to the extent 20/- of the cheque amount.

ORDER

This revision has been filed challenging the order passed by the learned District Munsif-cum-Judicial Magistrate, Thiruporur, dismissing the petitioner's application filed under Section 143 A of NI Act for a direction to the respondent herein to pay 20% of the cheque amount pending disposal of the trial.

2.The learned Magistrate dismissed the said application on the ground that the respondent cannot be directed to deposit the said amount until the conclusion of trial as the petitioner has to establish that the cheque was issued for a legally enforceable debt.

3.This Court is of the view that it is not mandatory in all cases to direct the accused to make a deposit pending trial. The learned Magistrate has exercised his discretion which cannot be faulted.

4.This Court finds no infirmity in the order passed by the Trial Court.

However, considering the fact that the cheque amount is huge, the Trial Court may expedite the trial.

5.With the above observations, this revision stands dismissed.

Consequently, connected miscellaneous petition is also closed.
