O R D E R
This Writ Petition is filed challenging the impugned proceedings issued by the 2nd respondent vide Na.Ka.No.101-1/2025 dated 02.07.2025 and also seeking for a consequential direction, directing the 2nd respondent to register the Gift settlement deeds in Doc.No.129/2022 dated 31.01.2022 and Doc.No.126/2022 dated 01.02.2022 presented by the petitioner dated 20.06.2025 and 26.06.2025 within the time stipulated by this Court.
2. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.
3. It is the case of the petitioner that the petitioner has executed settlement deeds dated 20.06.2025 and 26.06.2025 in favour of his father. When the same were presented for registration, the same were refused to be registered through the impugned order dated 02.07.2025, on the ground that the petitioner's brother has executed the gift settlement deeds in favour of the petitioner and he is involved in a criminal case.
Challenging the same, the petitioner has filed this Writ Petition.
4. The learned Special Government Pleader appearing for the respondents 1 and 2 would submit that initially, the petitioner's brother has executed gift settlement deeds in favour of the petitioners in respect of the subject property. He further submits that the petitioner's brother has running a Finance Company in the name and style of “Hammad Transport” and since the said finance company has not return the amount to the depositors, a case has been registered against the petitioner's brother in Crime No.3 of 2023 and the said case is pending before the TANPID Court. He further submits that the subject property was purchased by the petitioner's brother out of the funds collected from the depositors. Therefore, an attachment order was passed by virtue of G.O.(4D).No.249 (Pol-19), dated 23.12.2025 by the Home Department, attaching the subject property. Therefore, the 2nd respondent has rightly refused to register the gift settlement deeds presented by the petitioner.
5. I have considered the rival submissions made by both sides and also perused the materials available on record.
6. Considering the submissions made by the learned Special Government Pleader, since an attachment order has been made in respect of the subject property in G.O.(4D).No.249 (Pol-19), dated 23.12.2025, the respondents rightly refused to register the gift settlement deeds presented by the petitioner. Therefore, the right course available to the petitioner is to approach the TANPID Court for getting appropriate relief. Therefore, I do not find any reason to interfere with the impugned order and therefore, the Writ Petition is liable to be dismissed.
7. Accordingly, this Writ Petition is dismissed with the liberty to the petitioner to approach the TANPID Court, if he is so advised. There shall be no order as to costs.
