PRAYER: Petition filed under Article 226 of the Constitution of India
praying to issue a Writ of Habeas Corpus, directing the second
respondent to produce the body or person of the petitioner's minor
daughter Jessica Vetha, daughter of Vethanayagam, aged about 16 years,
before this Court and handover the custody to the petitioner.

O R D E R
(Order of the Court was made by G.K. ILANTHIRAIYAN,J.
This Habeas Corpus Petition has been filed for a direction
directing the respondents 1 & 2 to secure and produce the detenu, aged
about 16 years, before this Court.
1. The petitioner is the mother of the detenu. Her daughter, aged
about 16 years was missing and she has lodged a complaint before
the second respondent. On receipt of the said complaint, the
second respondent registered the FIR in Cr.No.54 of 2025 under
'Girl Missing'. On investigation, the second respondent found that
the detenu was kidnapped by one Sivabalan under pretext of love
affair and thereafter, the accused was arrested and remanded to
judicial custody and now altered the offence under Section 5 r/w 6
of POCSO Act.

3. The second respondent produced the detenu before this
Court. We enquired the detenu. She stated that she was kidnapped by
one Sivabalan under the pretect of love affair and now she is ready and
willing to go with the petitioner. The petitioner also appeared before this
Court and stated that she is taking care of the detenu. The detenu is
handed over to the petitioner.
4. In view of the above, this Habeas Corpus Petition is
closed.
