Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the entire records relating to the order dated 12.10.2022 made in the proceedings No. A.Thi.Mu.No.1700/A2/2022 on the file of the second respondent herein and quash the same and consequently direct the respondents to rectify the pay anomaly by stepping up the pay of the petitioner on par with junior and fix the same at Rs.22440/- as on 01.07.2010 and grant arrears of pay and other consequential monetary benefits.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus calling for the entire records relating to the order dated 12.10.2022 made in the proceedings No. A.Thi.Mu. No.1700/A2/2022 on the file of the second respondent and quash the same and consequently direct the respondents to rectify the pay anomaly by stepping up the pay of the petitioner on par with junior and fix the same at Rs.22,440/- as on 01.07.2010 and grant arrears of pay and other consequential monetary benefits.

2.The learned counsel appearing for the petitioner submitted that the petitioner is working as Headmaster, Panchayat Union Middle School, Pachapanatti, Kelamangalam Block, Hosur Educational District. The petitioner made representation to the respondents seeking to remove the pay anomaly between the petitioner and one V.Sikkanna who is working as Middle School Headmaster, however, the petitioner’s request was rejected without assigning any reason.

3.The learned counsel appearing for the petitioner further submitted that this Court may, without going into the merits of the case, set aside the impugned order and remand the matter back to the second respondent and issue direction to the second respondent to forward all the relevant papers to the first respondent and issue direction to the first respondent to pass a reasoned order with regard to the pay parity inbetween the petitioner and the said V.Sikkanna.

4.The learned Special Government Pleader appearing for the respondents submitted that the second respondent will forward the entire file to the first respondent and further submitted that the first respondent will pass appropriate orders within a reasonable time.

5.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, set aside the impugned order and remand the matter back to the second respondent. The second respondent shall forward all the relevant papers to the first respondent, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said papers, the first respondent shall consider the same and shall pass a reasoned order with regard to the pay parity inbetween the petitioner and the said V.Sikkanna, within a period of six weeks thereafter.
