5.R.Subakaran ... Respondents This case came up for settlement before the Lok Adalat. Both the parties are present. Mr.B.Murugavel, learned counsel for the appellant and Mr.P.Venkatachalapathy, Mr.A.Muralidharan, Mr.R.Hari, learned counsel for the respondents 1 to 4 are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT The respondents 1 to 4 herein filed M.C.O.P.No.1576 of 2022 before the trial Court claiming award amount of Rs.1,62,66,000/- towards compensation with interest.

2.The Trial Court awarded a sum of Rs.1,05,57,300/- along with interest and cost directing the appellant herein to pay the said amount to the respondents 1 to 4. Aggrieved by the above award passed by the Trial Court SBI General Insurance Company Limited filed an appeal before the Hon'ble High Court.

3. Both the parties having initiated negotiation successfully arrived at a settlement of all the issues arisen in this case as follows:

4.The appellant-SBI General Insurance Company Limited has agreed to pay a sum of Rs.1,28,73,000/- in full quit. The respondents 1 to 4 also have agreed to receive the said amount of Rs.1,28,73,000/- in full quit within four weeks after the award is passed by the National Lok Adalat. Both the parties made a formal request to the National Lok Adalat to pass award in terms of the above settlement.

5.As a result award is passed hereby in terms of the above compromise arrived at between the parties directing the appellant herein to pay a sum of Rs.1,28,73,000/- in full quit within a period of four weeks from the date of receipt of a copy of order passed by the National Lok Adalat.

The first respondent-Revathi will receive a sum of Rs.41,25,000/- (Rupees Fourty One Lakh and Twenty Five Thousand Only), (to be deposited Indian Overseas Bank, Kavarapettai Branch IFSC:IOBA0000622, bearing A/c.No.062201000015000), the 2nd respondent-Avinash, will receive a sum of Rs.41,24,000/- (Rupees Fourty One Lakh and Twenty Four Thousand Only) (to be deposited Indian Overseas Bank, Kavarapettai Branch IFSC:IOBA0000622, bearing A/c.No.062201000025000), the 3rd respondent-Akash, will receive a sum of Rs.41,24,000/- (Rupees Fourty One Lakh and Twenty Four Thousand Only) (to be deposited Indian Overseas Bank, Kavarapettai Branch IFSC:IOBA0000622, bearing A/c.No.062201000020000) and the 4th respondent-Muthu will receive a sum of Rs.5,00,000/- (Rupees Five Lakhs Only) (to be deposited Indian Overseas Bank, Ponneri Branch IFSC:IOBA0000380, bearing A/c.No.038001000050841) out of the award amount deposited by the Lok-Adalat. A sum of Rs.25,000/- deposited by the appellant at the time of filing the present appeal may be refunded to the appellant.

7.Consequently, the appeal stands disposed of. Consequently, connected Miscellaneous Petition if any, shall stand closed.
