PRAYER Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records of the respondents issue in No.E10/1/11035680/ADK/481 dated 11.09.2025 issued by the 3rd respondent and quash the same and issue a consequential direction to the Respondents not to reduce or alter the pay of the petitioner fixed on 01.01.2006 at Rs.21000 in the Pay Band of Rs.15600-39100+5400GP, notionally, and with effect from monetary benefits from 01.04.2013 as per the GO Ms.No.306 Finance (Pay Cell) Department dated 12.09.2018 and fix the corresponding pay in the Revision of Pay Scale from 01.01.2016 and then arrive at a last drawn pay and to fix pension and thereafter to grant arrears of pension and pensionary benefits.

ORDER

This writ petition has been filed challenging the order passed by the third respondent in No.E10/1/11035680/ADK/481 dated 11.09.2025 and to direct the respondents not to reduce or alter the pay of the petitioner fixed on 01.01.2006 at Rs.21,000/- in the Pay Band of Rs.15600-39100+5400GP, notionally, and with effect from monetary benefits from 01.04.2013 as per the G.O.Ms.No.306 Finance (Pay Cell) Department, dated 12.09.2018 and fix the corresponding pay in the Revision of Pay Scale from 01.01.2016 and then arrive at a last drawn pay and to fix pension and thereafter to grant arrears of pension and pensionary benefits.

2. Similarly placed person approached this Court in W.P.No.11882 of

2023. This Court, by an order dated 07.03.2025, held as follows :-

“6. The learned Government Advocate appearing for the respondents 1 to 5 would submit that by virtue of interim stay granted by this Court in the instant writ petition, as early as on 20/4/2023, amount has not been recovered. He would further submit that the petitioner was retired on 31/8/2022 and his last drawn pay was Rs.1,07,500/~.

The learned counsel appearing for the petitioner submitted that this Court in similar matters had directed the respondents to continue to pay the selection grade pay/special grade pay to the petitioner. To substantiate his case, he has produced a copy of the order dated 11/12/2023, made in W.P.Nos.17883 to 17887 of 2018.

8. In such a view of the matter, this writ petition is disposed of, directing the respondents to continue to pay the selection grade pay/special grade pay to the petitioner, subject to the condition that petitioner complies with all the other requirements. No costs. Consequently, connected Miscellaneous Petitions are closed.”

3. The above judgment squarely covers the issue involved in the present writ petition. Therefore, the order impugned in this writ petition cannot be sustained and is liable to be quashed. Accordingly, the order passed by the third respondent in No.E10/1/11035680/ADK/481 dated 11.09.2025 is hereby quashed.
