COMMON ORDER

The petition in W.P.(MD)No.3745 of 2022 has been filed seeking to quash the impugned order passed by the respondent dated 08.12.2021 in No.E/SC/TN/21/64 (E7032) and consequently to direct the respondent to restore the earlier order dated 20.10.2021 in the same proceedings forthwith.

2. The petition in W.P.(MD)No.3747 of 2022 has been filed seeking to quash the impugned order passed by the respondent dated 30.11.2021 in No.E/SC/TN/20/78 (E11929) and consequently to direct the respondent to renew the manufacturing licence No.E/SC/TN/20/78 (E11929) in favour of the petitioner forthwith.

3. This Court, by order dated 13.10.2025, allowed a similar writ petition in W.P.(MD) No.21060 of 2021, by quashing the impugned order passed therein. The relevant portion of the said order reads as follows:

“4. The entire country had come to a grinding halt on account of the Covid pandemic in the month of March 2020. On account of this lockdown, various activities particularly renewal of license, extension of orders etc., was not possible. The Hon- ble Supreme Court had passed an order in Miscellaneous Application No.665 of 2021 in SMW(C)No.3 of 2020, in which the writ appeal was disposed of with various directions, the first of which is as follows::

“ “In computing the period of limitation for any suit, appeal, application or proceeding, the period from 15.03.2020 till 02.10.2021 shall stand excluded. Consequently, the balance period of limitation remaining as on 15.03.2021, if any, shall become available with effect from 03.10.2021.”

4. The relief sought in the present writ petitions is similar in nature.

Therefore, following the above order, these writ petitions are allowed. Accordingly, the impugned orders passed by the respondent dated 30.11.2021 and 08.12.2021 are set aside. The respondent is directed to renew the licences from the year 2021–2022 onwards. The petitioner shall submit a fresh application for renewal of licence for the current year, and upon receipt of the same, the respondent shall consider and issue the licence for the year 2025–2026 within a period of two (2) months from the date of receipt of a copy of this order. Till such time, a temporary licence shall be issued to the petitioner. The petitioner shall run the fire works strictly in compliance with all prescribed safety measures. No costs.

Consequently, the connected miscellaneous petition is closed.
