ORDER

This Writ Petition has been filed to direct the 3^rd respondent to

cancel the patta standing in the name of the 5^th respondent for the

property morefully described in the prayer to this writ petition, based on

the petitioner’s representation, dated 21.01.2020.

2. Since the aforesaid representation has not been considered till

date, the petitioner has filed this writ petition.

3. Mr.C.Jayaprakash, learned Government Advocate, accepts

notice on behalf of the respondents 1 to 4. Since no adverse order has

been passed against the 5^th respondent in this writ petition, notice to the

5^th respondent in this writ petition is dispensed with.

4. No prejudice would be caused to any of the respondents, if the

petitioner’s representation as stated supra is considered on merits and in

accordance with law, after hearing the objections of the 5^th respondent as

well as any other third party whom the 3^rd respondent deems it fit to

enquire, within a time frame to be fixed by this Court.

5. This Court is not expressing any opinion on the merits of the

petitioner’s representation.

6. For the foregoing reasons, this Court directs the 3^rd respondent

to pass final orders on merits and in accordance with law, on the

petitioner’s representation, dated 21.01.2020 seeking for cancellation of

patta standing in the name of the 5^th respondent for the property morefully

described in the prayer to this writ petition, within a period of twelve (12)

weeks from the date of receipt of a copy of this order, after hearing the

objections of the 5^th respondent, and any other third party, whom the 2^nd

respondent deems it fit to enquire and after giving due consideration to

the supporting documents filed by the respective parties.
