Prayer : This Writ Petition is filed under Article 226 of the Constitution of

India to issue a writ of Mandamus, directing the respondents to give

necessary permission /sanction to allow the petitioner to de-silting and

clearing blockages in the canal passing my agricultural land in future to

allow the smooth flow and natural drainage of water in the canal adjoining

the petitioner's land based on his representation dated 19.04.2025.

ORDER

The petitioner is the owner of the property situated in S.No.168/1,

182/4 and 227/1 of Minnakkal Village, Rasipuram Taluk, Namakkal

District. A water channel runs abutting the said land, carrying water from

the Ponsori Hills situated to the north-east of the said water channel. The

water flowing from the said hills run into a lake namely, Chinna Eri, situated

on the eastern side of the petitioner’s property.

2. Due to the accumulation of sediments, the water channel was

blocked, causing water to overflow into the petitioner’s agricultural land and

damaging the crops. Pointing out these difficulties, the petitioner made a

representation dated 19.04.2025, seeking removal of sediments to ensure

free flow of water into Chinna Eri. As no action was taken, the petitioner

approached this Court by way of present writ petition.

3. Mr.Shajahan, learned Special Government Pleader who took notice

submitted to this Court that he had been informed that the remedial steps

have been taken by the 5th respondent namely, the Block Development

Officer, Venanndur Panchayat, Rasipuram Taluk, Namakkal District.

4. After suffering a couple of adjournments, when I took up the

matter today, Mr.Shajahan reported that he has been instructed by the

Tahsildar, 6^th respondent that, within a period of ten days, the channel will

be cleared and the sediments removed, so as to ensure smooth flow of water

into the lake.

5. Mr.Shajahan further states that immediate action is being initiated

at the instance of the respondent Nos.5 and 6. The said statement of the

learned Special Government Pleader is recorded.

6. There shall be a direction to the respondent Nos.5 and 6 to clear

the channel as stated by them and to file a compliance report through the

Special Government Pleader .

7. In view of the above, this writ petition is ordered, No costs.

Call after two weeks for reporting compliance.
