ORDER

This Writ Petition has been filed seeking a Writ of Mandamus directing the

respondents to consider the petitioner’s representation dated 28.10.2025 and patta

application dated 05.09.2025 and to issue an individual patta in favour of

Arulmigu Murugan Temple, represented by its Trustee, V. Duraimani, in respect

of the property in Survey No.15/16, Pattadaikatti Village, Sankarankovil Taluk,

Tenkasi District, within a time frame to be fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the

admission stage itself.

3. The learned counsel for the petitioner would submit that the subject

property belongs to Arulmigu Murugan Temple and that the petitioner is the

present Trustee of the said temple. The petitioner had submitted a patta

application dated 05.09.2025, followed by a representation dated 28.10.2025,

seeking issuance of an individual patta in respect of the temple property situated

in Survey No.15/16, Pattadaikatti Village, Sankarankovil Taluk, Tenkasi District.

Despite the same, the respondents have not considered the petitioner’s application

and representation till date. The inaction on the part of the respondents is

arbitrary and has compelled the petitioner to approach this Court.

4. The learned Government Advocate appearing for the respondents would

submit that the petitioner's application will be considered on its merits and

appropriate orders will be passed in accordance with law, within a time frame to

be fixed by this Court.

5. Recording the above submission, and without expressing any opinion on

the merits of the matter, this writ petition is disposed of with a direction to the

second respondent to consider the petitioner's application dated 05.09.2025, on

merits and in accordance with law and pass appropriate orders within a period of

sixteen weeks from the date of receipt of a copy of this order. The application

shall be considered and disposed of after conducting an enquiry. The second

respondent is directed to provide reasonable opportunity during such enquiry to

the petitioner and also any other persons, who may be affected by such decision.

There shall be no order as to costs.
