fraudulently obtained patta in respect of Patta No.2774, Palaiyam Village,

ORDER
This Writ Petition is filed seeking a Writ of Mandamus directing the
respondents 1 and 2 to consider the petitioner’s representation dated 12.11.2025
and to cancel the patta fraudulently obtained in respect of Patta No.2774,
Palaiyam Village, Guziliamparai, Dindigul District.
2. By consent, the Writ Petition is taken up for final disposal at the
admission stage itself.
3. Since no adverse orders are going to be passed against the respondents 3
to 5, notice to the respondents 3 to 5 is hereby dispensed with.
4. The learned counsel for the petitioner would submit that the subject
property is ancestral in nature and that Patta No.2774 relating to the property
situated at Palaiyam Village, Guziliamparai, Dindigul District, has been
fraudulently obtained by the private parties. Therefore, the petitioner submitted a
detailed representation dated 12.11.2025 to the respondents 1 and 2 seeking

cancellation of the said patta. Despite the same, no action has been taken by them
till date. The continued inaction is arbitrary and has compelled the petitioner to
approach this Court.
5. The learned Government Advocate appearing for the respondents 1 and 2
would submit that the petitioner's representation will be considered and
appropriate orders will be passed on merits and in accordance with law within a
time frame to be fixed by this Court.
6. Recording the above submission, and without expressing any opinion on
the merits of the matter, this writ petition is disposed of with a direction to the
respondents 1 and 2 to consider the petitioner's representation dated 12.11.2025,
and pass appropriate orders on merits and in accordance with law, after affording
an opportunity of hearing to all the necessary parties, within a period of twelve
weeks from the date of receipt of a copy of this order. Needless to state that in the
event of any rival claims, the parties are at liberty to work out their remedies
before the Civil Court. There shall be no order as to costs.
