Prayer : Criminal Original Petition is filed under Section 528 of BNSS,

2023, to direct the Respondent No.1 and 2 to execute non bailable

warramt (NBW) issued by the Chief Judicial Magistrate, Thanjavur at

Kumbakonam in Cr.M.P.No.769 of 2015 dated 17.10.2025 at the hands

of the 2nd respondent police by considering the petitioner's

representation, dated 15.12.2025 within a stipulated time as fixed by

this Court.

ORDER

Seeking to execute the non-bailable warrant against the 3rd

respondent issued by the learned Chief Judicial Magistrate, Thanjavur

at Kumbakonam in Cr.M.P.No.769 of 2015 dated 17.10.2025, this

criminal original petition is filed.

2. The petitioner is the wife of the 3rd respondent against whom

non-bailable warrant has been issued by the learned Chief Judicial

Magistrate, Thanjavur at Kumbakonam in Cr.M.P.No.769 of 2015 dated

17.10.2025. So far, the same has not been executed by the respondent

police. Therefore, the petitioner sought indulgence of this Court.

3. Heard the learned counsels on either side and carefully perused

the materials available on record.

4. In view of the submission made by the learned counsel for the

petitioner, the 2nd respondent police is directed to execute the warrant

issued by the learned Chief Judicial Magistrate, Thanjavur at

Kumbakonam in Cr.M.P.No.769 of 2015 dated 17.10.2025 against the

3rd respondent herein forthwith.

5. With the above directions, this Criminal Original Petition is

allowed. Post on 16.02.2026 for reporting compliance.
