Habeas Corpus Petition filed under Section 226 of the Constitution of
India to issue a Writ of Habeas Corpus to direct the respondents herein to
produce the petitioner’s father M.Radhakrishnan, S/o.Muthusamy, male,
aged about 84 years, before this Court and set him at liberty.

This habeas corpus petition has been filed by the petitioner to secure
his father M.Radhakrishnan, S/o.Muthusamy, aged about 84 years, before
this Court and set him at liberty.
2. It is the case of the petitioner that his father viz. Radhakrishnan,
aged about 84 years, went missing from the house on 08.05.2025 around
10.30 a.m.; since the whereabouts of his father were not known, on the same
day i.e. on 08.05.2025 around 7.30 p.m., he lodged a written complaint
before the third respondent/police, pursuant to which, an FIR in Crime

No.20 of 2025 under “man missing” was registered; since, the police are not
taking effective steps to secure his father, he has preferred the present
petition.
3. The learned Additional Public Prosecutor appearing for the
respondents would submit that pursuant to the complaint given by the
petitioner, a case has been registered and the same is under investigation.
4. It is not the case of the petitioner that his father has been
illegally detained by any known or unknown person. In the complaint itself,
it has been stated that a man aged about 84 years went missing from
08.05.2025.
5. In such view of the matter, it cannot be stated that the
petitioner’s father is in illegal custody of anyone for the issuance of writ of
habeas corpus.
Hence, this habeas corpus petition is closed. However, the
respondents/police are directed to expedite the investigation and try to

secure the detenu forth with and keep the petitioner informed of the
developments, if any.
