Habeas Corpus Petition filed under Section 226 of the Constitution of

India to issue a Writ of Habeas Corpus to direct the second respondent to

produce the petitioner’s minor daughter viz. Arthi, D/o.N.Jothilakshmi, aged

about 13 years, before this Court from the custody of the third respondent

and handover to the petitioner.

ORDER

(made by P.VELMURUGAN, J.)

This habeas corpus petition has been filed by the petitioner to secure

her daughter viz. Arthi, aged about 13 years and produce her before this

Court and set her at liberty.

2. It is the case of the petitioner that her daughter Arthi, aged

about 13 years, went missing from the house on 10.011.2023 at 3.00 p.m.

and thereafter, her whereabouts are not known and therefore, she lodged a

complaint before the second respondent/police, based on which, a case in

Crime No.68 of 2023 for “girl missing” was registered; the allegation in the

complaint itself is that the detenue has been kidnapped by the third

respondent, who is none other than the paternal uncle-married man with wife

and children; since, the police are not taking effective steps to secure her

daughter, she has preferred the present petition.

3. The Additional Public Prosecutor appearing for the respondents

1 and 2 produced a status report filed by the second respondent/police before

this Court stating as to what are the steps have been taken to secure the

detenue.

4. It is seen that though the respondents/police are taking effective

steps to secure the detenue, they were unable to secure her so far.

Recording the status report, this habeas corpus petition is closed.

However, the respondents/police are directed to expedite the investigation

and try to secure the detenue forth with and produce her before the

Magistrate concerned under intimation to the petitioner.
