Writ Petition has been filed under Article 226 of the Constitution of India,

praying to issue a Writ of Certiorari Mandamus to call for the records pertaining to the

Transfer cum Conduct Certificate in T.C.No.13420 dated 22.11.2025 issued by the

respondent No.3 and to quash and consequently direct the respondent No.3 to permit

the petitioner to continue his 3-year L.L.B course within a stipulated time fixed by this

Hon’ble Court.

ORDER

This writ petition is filed for a writ of Certiorarified Mandamus to call for the

records pertaining to the transfer-cum-conduct certificate in T.C.No.13420 dated

22.11.2025 issued by the respondent No.3-college, to quash and consequently, to direct

the respondent No.3 to permit the petitioner to continue his 3 years L.L.B course within

a stipulated time fixed by this Hon’ble Court.

2.Upon hearing the learned counsel for the petitioner and perusing the affidavit

filed in support of the writ petition, the grievance of the petitioner is that, the petitioner

is a student in the third respondent-college, which is a private Law College. It is the

allegation on the part of the student that when his attendance for the 5^th semester was

well within the condonable limit and it was also condoned and when he was writing the

examination, in between, the transfer certificate came to be issued to him. According to

the student, proper opportunity was not given with respect to the allegations and he did

not commit any misconduct at all.

3. The learned counsel appearing on behalf of the third respondent-college

would submit that on account of certain misconducts, when a disciplinary enquiry was

sought to be taken, in the best interest of students, it was agreed that the student would

get the transfer certificate and get enrolled in some other college.

4. I have considered the rival submissions made on either side and perused the

material records of the case.

5. A normal transfer certificate and conduct certificate have been issued by the

3^rd respondent college and there is no stigma or reference to any misconduct.

Therefore, the contention of the learned counsel for the petitioner that the petitioner

never committed any misconduct and that no opportunity was given, need not be gone

into.

6. On the other hand, when the matter came up on the last occasion, this Court

directed the petitioner and his parents to take a pragmatic approach and also requested

the respondents, whether the student can be facilitated to attend some other college so

that it will result in a win-win situation, as the student’s education shall also be

continued, at the same time, the 3^rd respondent-college also does not face any problem

in the conduct of the college, especially in matters relating to discipline. In that

background, without adjudicating on any of the issues or causing stigma on any person,

the Court directed the exercise to be undertaken.
