PRAYER: Writ Petition is filed under Article 226 of the Constitution of

India, to issue a Writ of Certiorari, to call for the records of the 1st respondent

in Na.Ka.No. 19310/F4/2021 dated 22.12.2021 and quash the same as illegal

and arbitrary.

O R D E R

The present writ petition has been filed challenging the communication

of the first respondent to all the District Collectors, wherein the District

Collectors have been instructed not to directly grant leasehold rights to the

fishermen cooperative society without conducting public auction.

2. According to the learned counsel for the writ petitioner, this order

takes away priority rights granted in favour of the fishermen's cooperative

society. He also referred to the judgment of the Hon'ble Division Bench,

wherein it has been held that fishermen's cooperative society should be

directed to match the highest bidder, who has participated in the auction.

3. The learned Special Government Pleader appearing for the

respondents brought to the notice that the Government has issued

G.O.Ms.No.05, Animal Husbandry, Dairying, Fisheries and Fishermen

Welfare Department, dated 30.01.2025, wherein the priority rights of the

fishermen cooperative society have been preserved.

4. In view of the subsequent G.O., nothing remains to be adjudicated.

Hence, this writ petition is disposed of. No costs. Consequently, connected

miscellaneous petitions are closed.
