Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents to consider the petitioner’s representation dated 22.03.2025 for the upgradation of the Middle School to High School.

ORDER (Order of the Court was made by the Hon'ble Chief Justice)

This petition has been filed seeking issuance of a direction for upgradation of an existing school.

2. Learned State counsel, at the outset, brought to the notice of this Court that the demand of the petitioner and the villagers for upgradation of the school refers to a land which was earlier allotted to

8th respondent, but, later on, it was cancelled. He would submit that the 8th respondent has now filed a writ petition challenging the cancellation, which is pending consideration.

3. No direction can be issued at this stage in this petition so as to involve a land which is already subject matter of consideration before the Writ Court.

4. Reserving liberty to revive the petition, this petition, at this stage, is disposed of. The petitioner would have liberty to revive depending upon the fate of the pending writ petition.

There shall be no order as to costs. Consequently, the interim application stands closed.
