ORDER
By asserting that the petitioner owns 38 cents in Survey No.103/2B, the petitioner approached the third respondent for the registration of two settlement deeds for extents of 19 cents each. At that juncture, the petitioner discovered that 19 cents in Survey No.103/2B had been sold on 16.11.1995 to one Mr.P.Elangovan under sale deed dated 16.11.1995 bearing Document No.1866 of 1995. After submitting two representations seeking cancellation of the said sale deed, the present writ petition has been filed.
2. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for respondents 1 to 5. He submits that the registering officer is not entitled to adjudicate on title to property or to cancel instruments registered earlier.
3. The petitioner has approached this Court in 2026 seeking cancellation of sale deed bearing Document No.1866 of 1995 and settlement deed bearing Document No.4368 of 2025. As submitted by the learned Special Government Pleader, the registering officer does not have the power to adjudicate on title or to cancel the instruments registered earlier. In those circumstances, no purpose would be served by directing even an enquiry. Therefore, by leaving it open to the petitioner to approach the jurisdictional Civil Court in accordance with law, this writ petition is disposed of. Needless to say, it is also open to the petitioner to lodge a complaint with jurisdictional police in accordance with law. There shall be no order as to costs. 27.01.2026 Index:Yes/No Neutral Citation:Yes/No mmi To
