PRAYER: Writ petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Certiorarified Mandamus, calling for the records of the impugned Refusal Slip dated 12.12.2025 in Refusal No.RFL /Jalakandapuram/61/2025 issued by the 3rd Respondent and quash the same and Consequently direct the 3rd Respondent to register the Sale Deed of the Petitioners dated 12.12.2025 in respect of their property in survey No.107/2 (New S.No.107/90A1B) Measuring to an extent of 1479.25 Sq. ORDER
The petitioners assert that they are the dharmakartha and hereditary Administrator, respectively, of the Arulmigu Sri Selvamariamman Temple. It is also stated that the petitioners purchased the property for the temple on
26.07.2010. Subsequently on account of the requirement for funds in relation to a construction being put up for the temple, the petitioners decided to sell the property under sale deed dated 12.12.2025. Because the request for registration was declined under the refusal check slip dated 12.12.2025, the present writ petition has been filed.
2. Learned counsel for the petitioners submits that the sale is also being done for the welfare of the temple. He relies upon the resolution passed by the village panchayat.
3. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for all the respondents. By comparing sale deed dated 26.07.2010 and sale deed dated 12.12.2025, he submits that the sale deed presented for registration now contains a recital that the petitioners are the owners and that this is in contrast to the recitals of the earlier sale deed to the effect that the properties are being purchased for and on behalf of the temple. In response to this contention, learned counsel for the petitioners points out that the present sale deed also indicates that the sale deed is being executed for and on behalf of the temple.
4. On perusal of sale deed dated 12.12.2025, it appears from the recitals at internal page 2 thereof that the property being dealt with is the individual property of the petitioners. Therefore, it is necessary that the sale deed be re- drafted to indicate clearly that it is the property of the temple before being re- presented for registration. Subject to this condition being satisfied, and subject to fulfilment of other requirements relating to registration, upon re-presentation, after verifying with the HR and CE Department and being satisfied that it is a private temple, necessary measures for registration shall be taken within two weeks from the date of re-presentation. The impugned refusal check slip is set aside and the writ petition is disposed of on the above terms. No costs.
Consequently, the connected writ miscellaneous petition is closed.
