O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to conduct a survey and fix the four boundaries of the petitioner’s land comprised in Survey No.789/4A, measuring an extent of 0.40.00 acres in Patta No.767, situated at Thirukkalur Village, Palangulam, Thoothukudi District, based on the petitioner’s application dated 20.05.2024 and representation dated

20.12.2024.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the petitioner would submit that an online application has been submitted for the survey of the property in question and for demarcation of its boundaries and a representation has also been submitted.

4. The learned Special Government Pleader appearing for the respondents, on instructions, would submit that after consideration of the claims of the parties, proper steps would be taken to survey and demarcate the land in question in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

5. Recording the aforesaid submissions, this Court directs the respondents to consider the online application of the petitioner dated 20.05.2024 and also his representation dated 20.12.2024, survey and demarcate the petitioner’s land after consideration of the claims of all parties including the other joint pattadars and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the Civil Court. It is needless to state that before surveying the land, notice shall be issued to the adjacent landowners and other interested parties.

6. With the above directions, this Writ Petition stands disposed of.

There shall be no order as to costs.
