ORDER

This writ petition has been filed for a mandamus to direct the 1st respondent to preserve the CCTV - footages fixed in Front of Public Entrance of Hospital with Emergency Minor-OP, without any delay from 10.00 pm.,on 12.11.2023 upto 12.30 am., on 13.11.2023, (totally 2.30 Hours only) in order to protect the innocent petitioner from one murder case registered by the 3rd respondent police falsely implicated by way of purportedly co-accused confession in Crime No.617 of 2023, dated 13.11.2023, based on petitioner's representation dated 22.12.2023 within a stipulated time.

2. Heard the learned counsel for the petitioner, learned Special Government Pleader for the first respondent and the learned Government Advocate for the respondents 2 and 3.

3. The petitioner has given a representation to the respondents on

22.12.2023 to preserve the CCTV footage of the Hospital. As the petitioner was wrongly implicated in a criminal case, the said representation was given to preserve the said footage to prove the innocence of the petitioner. However, since the said representation was not considered, he is before this Court.

4. When the matter was taken up for hearing, the learned Special Government Pleader would submit that the CCTV footage has been preserved and the same was produced before the third respondent.

5. Since the footage has been preserved, no orders need to be passed in this writ petition. Accordingly, the writ petition stands closed. However, if the petitioner still requires any footage, he can make an application to the third respondent, in which case, it is for the third respondent to consider and pass orders. No costs. Consequently connected Miscellaneous Petition is closed.
