ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent to grant enhanced compensation in respect of the petitioner’s land situated in Survey No.14/1D3, at Silarpatti Post, Peraiyur Taluk, Madurai District, measuring an extent of 0.00.84 square metres, by duly following the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, and by considering the petitioner’s representation dated 20.03.2023.

The learned counsel for the petitioner submits that the petitioner’s land in Survey No.14/1D3, measuring an extent of 0.00.84 square metres, situated at Silarpatti Post, Peraiyur Taluk, Madurai District, has been acquired by the respondents. However, compensation has not been fixed in accordance with the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Aggrieved by the same, the petitioner made a representation dated 20.03.2023 seeking enhancement of compensation, which has not been considered till date. Hence, the present Writ Petition has been filed seeking a direction to the first respondent to consider the petitioner’s representation and grant enhanced compensation in accordance with law.

3. The learned Government Advocate appearing for the respondents 1 and 2 would submit that the first respondent would pass appropriate orders on the representation of the petitioner on merits and in accordance with law within a time frame to be fixed by this Court.

4. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's representation 20.03.2023, on merits and pass appropriate orders in accordance with law after providing reasonable opportunity of hearing to the petitioner and any other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
