ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents 1 to 5 to rectify the erroneous classification entered in the revenue records in the light of the judgment and decree passed in O.S.No.584 of 1994, on the file of the Additional District Munsif Court, Padmanabhapuram, dated 17.04.1997, and consequently to issue patta in the petitioner’s name in respect of the land comprised in Re-Survey Nos.478/1 and 478/9A (Old Survey No.4535), Old Kothanalloor Village (now Kumarapuram Village), Kalkulam Taluk, Kanyakumari District.

The learned counsel for the petitioner submits that the petitioner is the absolute owner of the land comprised in Re-Survey Nos.478/1 and 478/9A (Old Survey No.4535), Old Kothanalloor Village (now Kumarapuram Village), Kalkulam Taluk, Kanyakumari District. The petitioner’s title and entitlement over the said property stand conclusively established by the judgment and decree dated 17.04.1997 passed in O.S.No.584 of 1994 by the Additional District Munsif Court, Padmanabhapuram. However, despite the said decree, the revenue records continue to reflect an erroneous classification, and patta has not been issued in the petitioner’s name. Hence, the petitioner seeks a direction to the respondents 1 to 5 to rectify the erroneous entries in the revenue records in the light of the said judgment and decree and to issue patta in the petitioner’s name.

3. The learned Special Government Pleader appearing for the respondents would submit that the competent authority is the third respondent and that the third respondent would pass appropriate orders on merits and in accordance with law within a time frame to be fixed by this Court.

Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 16.12.2024, on merits and pass appropriate orders in accordance with law after providing reasonable opportunity of hearing to the petitioner, and any other persons, who may be affected by such decision, within a period of sixteen weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
