ORDER

The petitioner had applied for the registration of a society under the name ‘Coimbatore Document Registration Advocates Association’. In relation to the said request for registration, the respondent called upon the petitioner to obtain no objection from the Coimbatore Advocates Association and the Document Writers Association. The said communication is challenged in this writ petition.

2. Ms.Akila Rajendran, learned Government Advocate, accepts notice for the sole respondent. On the basis of written instructions, she submits that the names of the 12 advocates could not be traced in the rolls of the Bar Council. In order to ascertain the genuineness, she submits that the impugned communication was issued. This contention is opposed by learned counsel for the petitioner on the ground that the reasons mentioned by learned Government Advocate on the basis of written instructions do not find place in the impugned communication. To that extent, he is correct.

3. The Tamil Nadu Societies Registration Act, 1975 provides that no society shall be registered by a name which, in the opinion of the registrar, is undesirable. The Explanation to the said Section 9 prescribes that a name which is identical with or nearly resembles the name of an existing society would be undesirable. The communication should be viewed in that context. If so viewed, it is in line with the statutory duties of the registrar. Therefore, I find no infirmity in the impugned order warranting interference. Consequently, the writ petition stands dismissed without any order as to costs.
