PRAYER :- Writ Petition filed under Article 226 of the Constitution

of India, praying this Court to issue a Writ of Mandamus,

directing 1 and 2 respondents herein to take appropriate action

against the 5^th respondent for running a men's hostel without

obtaining proper permission at the residential locality in the light

of petitioner's representation dated 25.11.2023 within a stipulated

period as may be fixed by this Court.

ORDER

The prayer in this writ petition is to issue a Writ of

Mandamus, directing the respondents 1 and 2 herein to take

appropriate action against the 5^th respondent for running a men's

hostel without obtaining proper permission at the residential

locality in the light of petitioner's representation dated 25.11.2023

within a time frame.

2. Learned counsel for the petitioner would submit that

the 4^th respondent has leased out his property to the 5^th respondent

for running a men's hostel and without obtaining

permission/licence under Section 5 of the Tamil Nadu Hostels

and Homes for Women and Children (Regulation) Act, 2014, the

5^th respondent is running a men's hostel in the residential area.

The hostelers of the 5^th respondent's hostel are creating several

nuisances. Therefore, the petitioner made a representation dated

25.11.2023 to the authorities to take appropriate action against the

5^th respondent and the same was not considered. Hence, this writ

petition.

3. Reading of Section 5 of the Tamil Nadu Hostels and

Homes for Women and Children (Regulation) Act, 2014, shows

that the said Act is enacted for regulation of hostels, lodging

houses, homes for women and children and other like institutions

and for matters connected therewith. Even as per Section 2(e) of

the said Act (e) ''hostel'' or ''lodging house'' means a building in

which accommodation is provided for women or children or both,

either with boarding or not. Thus it is explicit that the said Act is

not enacted for regulation of the men's hotel. In this case, the 5^th

respondent is running a men's hostel. Therefore, the provisions of

the Tamil Nadu Hostels and Homes for Women and Children

(Regulation) Act, 2014, do not have any application to the case on

hand and the prayer of the petitioner cannot be directed to be

considered in the light of the said Act. The petitioner has

misconceived the provisions of the said Act and has filed this writ

petition without application of mind.

4. Hence, the Writ Petition is dismissed as devoid of

merits. No costs.
