Prayer : Writ Petition filed under Article 226 of the Constitution of India
praying for issuance of Writ of Mandamus, forbearing the respondent
entertaining any request for mutation of revenue records and issue of patta or
cancellation of the patta standing in the name of Minor Elamaran, in respect of
the extent of 39 and ¾ cents (equivalent to 0-16-00 Hectares) in S.No.68/16B
out of 72 cents in S.No.68/16 of Melkalavaay Village, Gingee Taluk,
Villupuram District till the disposal of O.S.No.285 of 2022 on the file of the Sub
Court Gingee at the instance of any one claiming through and under Mr.
Devaraj alias Devarajan.

ORDER
This Writ Petition has been filed to forbear the respondent from
entertaining any request for mutation of revenue records for the property
morefully described in the prayer to this writ petition.
2. Mr.D.Ravichander, learned Special Government Pleader, accepts
notice on behalf of the respondent.
3. According to the petitioner, the property morefully described in the
prayer to this writ petition is owned by her son, namely minor Elamaran,
represented by the petitioner. By virtue of a settlement deed executed in favour
of said minor Elamaran, the petitioner claims that the subject property is owned
by the said minor Elamaran. According to the petitioner, patta was also issued in
favour of the said minor Elamaran, which is now sought to be cancelled by
Mr.Devaraj @ Devarajan, who is the grandfather of the minor Elamaran and
father-in-law of the petitioner. The petitioner apprehends that without any
notice, the respondent may cancel the patta issued in favour of the minor
Elamaran.
4. Necessarily, whenever an application seeking for cancellation of patta
is submitted, the respondent will have to hear all the necessary parties, including

the persons in whose name patta stands. Since the patta for the property
morefully described in the prayer to this writ petition now stands in the name of
the petitioner’s minor son Elamaran, necessarily, any request for cancellation of
patta standing in the name of the minor Elamaran can be decided by the
respondent only after hearing the objections of the petitioner and her minor son
Elamaran.
5. This Court is not expressing any opinion on the merits of the matter.
However, necessarily, the petitioner and her minor son Elamaran have to be
heard before deciding any application seeking for cancellation of patta standing
in the name of minor Elamaran.
6. For the foregoing reasons, this Court directs the respondent to issue
notice to the petitioner and her minor son Elamaran before passing final orders
on any application submitted either by Mr.Devaraj @ Devarajan or any third
party seeking for cancellation of minor Elamaran’s patta and only after hearing
the objections of the petitioner and her son minor Elamaran, final orders can be
passed by the respondent in the application seeking for cancellation of patta
now standing in the name of the minor Elamaran for the property morefully
described in the prayer to this writ petition.

7. With the aforesaid directions, this Writ Petition is disposed of. No
