PRAYER
Directing the 3rd to take appropriate action for closure or relocate the TASMAc
shop no 11426 situated at Jayankondan Village, Gingee Taluk, villupuram
Distrct which is functioning in violation of Rule 8 of the Tamil nadu Liquor
Retail Vending (in shops and Bars) rules 2003 by disposing the petitioners
written rprsentation dated on 24.03.2025 within a time frame to be fixed by this

ORDER
This writ petition has been filed to direct the third respondent to close
down or relocate the subject TASMAC shop morefully described in the prayer
to this writ petition based on the petitioner’s representation dated 24.03.2025.
2. Earlier, the petitioner had approached this Court by filing
W.P.No.38995 of 2024, seeking for closure of two TASMAC shops. By the

order dated 21.12.2024, the respondents were directed to consider the
petitioner’s representation seeking for closure of two TASMAC shop within the
time frame fixed by the Court in the said order.
3. It is now brought to the notice of this Court by the learned counsel for
the petitioner that one of the TASMAC shops was alone closed based on the
directions issued by this Court on 21.12.2024 in W.P.No.38995 of 2024.
According to him, the subject TASMAC shop morefully described in the prayer
to this writ petition was not ordered to be closed. He also submit that the
petitioner has not received any order passed by the respondents pursuant to the
directions issued by this Court on 21.12.2024 in W.P.No.38995 of 2024.
4. The learned Government Advocate appearing for the official
respondent would submit that the subject TASMAC shop morefully described in
the prayer to this writ petition was not ordered to be closed. But, only the other
shop which is also the subject matter of W.P.No.38995 of 2024 was ordered to
be closed.
5. The learned Government Advocate appearing for the official
respondents would also submit that if a direction is issued, the order passed by
the respondents pursuant to the directions issued by this Court on 21.12.2024 in
W.P.No.38995 of 2024 will be furnished to the petitioner. He would also submit

that the petitioner will have to challenge the said order if aggrieved by the same
and cannot file a writ of mandamus as prayed for in this writ petition.
6. The learned counsel for the petitioner, on instructions, would therefore
submit that the petitioner is willing to challenge the order passed by the
respondents pursuant to the directions issued by this Court on 21.12.2024 in
W.P.No.38995 of 2024, provided the order copy is furnished to the petitioner.
