Respondents Prayer : Petition filed under Article 226 of the Constitution of India praying to issue a writ of habeas corpus and direct the respondents to produce my daughter Shangamithra, D/o K.Ravikumar, aged about 23 years, (detenu) bodily or in person before this Hon’ble Court and set her at liberty.

This Habeas Corpus Petition has been filed by one K.Ravikumar seeking production of his daughter K.Shangamithra/detenue, who he claims, is missing.

2. This is not the first petition that the petitioner has filed. He had earlier filed H.C.P.No.1888 of 2024 seeking the same prayer. That petition had come to be dismissed on 08.08.2024, the Division Bench noticing that the detenue was aged 22 (as on that date), and is living along with her mother. Her mother and the petitioner were earlier married but have been legally separated since 2005. The brother of the detenue was with the petitioner and we are given to understand that he is no more now.

3.The petitioner, represented by Mr.Vetriselvan for whom Mr.S.R.Rajagopal, learned Senior Counsel appears, states that he wishes to rekindle his relationship with his daughter.

4. The main objection of the petitioner is that in order dated

08.08.2024, the Court has recorded the statement of the petitioner to the effect that she was studying in Kevin Arts and Science College, Chennai. However, the college has confirmed, vide communication dated

08.12.2025, that there is no student there by name K.Shangamithra. 5. Mr.A.Gokulakrishnan, learned Additional Public Prosecutor appears for the official respondents and Mr.V.Sakkarapani, appears for detenue. The detenue narrates the following facts in the course of our conversation with her as follows. She has been with her mother almost since birth and the petitioner is unknown to her. She is very categoric that she does not wish to have any relationship with the petitioner.

6. She has just completed a course in the Tamil Nadu Dr.J.Jayalalithaa Music and Fine Arts and University, majoring in painting and has legally changed her name to K.Sruthikamalini. A copy of gazette dated 11.12.2017 is given to us. We wish this gazette notification had been produced before the Court even on the earlier occasion.

7. Be that as it may, since the detenue, now called K.Sruthikamalini, has expressed her wishes in clear terms, stating that she does not wish to meet the petitioner, there is nothing more to be said in the matter. In view of the express wish of the detenue, there shall be no further attempt by the petitioner to contact her, or to connect with her, in any manner.

8. This Habeas Corpus Petition is dismissed. No costs.
