Respondents PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the first respondent to dispose within time frame the petition filed by the petitioner field to revoke the order of the second respondent dated 16.04.2024 in Consent Order No.2401157846193 issued to the third respondent company.

Heard.

2. Despite the order of this Court in the first round of litigation [W.P.No.42948 of 2025] that: (i) without challenge to the order passed by the authority granting consent, the petition is not maintainable; and (ii) if a challenge is to be laid to the consent to operate order issued by the Pollution Control authorities, the remedy lies before the appellate authority constituted under the laws, the petitioner has again rushed to this Court.

3. It is argued that, after the order was passed by this Court, a petition has been filed under Section 17 of the Water (Prevention and Control of Pollution) Act, 1974.

4. We find that without filing any appeal before the appellate authority constituted under law, again submission was done in form of a representation.

5. The petition is frivolous. With the liberty reserved earlier in W.P.No.42948 of 2025, dated 14.11.2025, this writ petition is dismissed with costs of Rs.25,000/- (Rupees Twenty Five Thousand only) payable to the Tamil Nadu State Legal Services Authority, within a period of one month from today.
