23.10.2025.

2. On the allegation of encroachment having been made on the waterbody and water channel by the private respondents herein, learned State counsel would submit that all the representations have been made to the District Collector and the Tahsildar, respectively. He submits that when the allegation of encroachment is on waterbody and water channel, the competent authority to take action would be the concerned Executive Engineer, Water Resources Department.
3. Let the petitioner submit a representation to the competent authority of the Water Resources Department. If any such representation is made, the same shall be examined, survey conducted and if any waterbody and water channel is found encroached, the same shall also be removed as early as possible.
4. The writ petition is, accordingly, disposed of. There shall be no order as to costs.
