PRAYER: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents to consider the representation dated 10.06.2024 and consequently to direct the respondents to remove the encroachment of water body (pond) namely ‘manal kalvai’ and ‘peria obulapuram lake’.

Allegations made in this petition that there are encroachments on water body have been responded by the respondents by filing a counter. The counter affidavit shows that on the land comprised in different areas and villages, proceedings have been drawn against those who are alleged to be encroachers and these proceedings are pending at different stages.

2. We direct the respondents to conclude the proceedings to verify complaints of encroachments on water body and revenue land as early as possible and, in any case, within an outer limit of three months from the date of receipt of a copy of this order. If there is no stay in any proceedings by any court or appellate authority, it goes without saying that appropriate action for removal of encroachment, if any, should be taken forthwith. The District Collector, Thiruvallur, shall ensure compliance of this order.

3. Writ Petition is disposed of. There shall be no order as to costs.
