PRAYER Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus, forbearing the Respondents 1 to 4 from interfering with the petitioner’s possession in lands bearing S.No.221/11 (Old S.No.78/1) Pallipadai Village, Chidambaram Taluk, Cuddalore District till the disposal of statutory Revision Petition dated 13.10.2025 (filed on 15.10.2025) pending on the file of the First Respondent on merits and in accordance with law.

ORDER

(Order of the Court was made by S.M.Subramaniam J.)

Writ of Mandamus has been instituted to forbear the respondents 1 to 4 from interfering with the petitioner’s possession.

2.Relief as such sought for in the present writ petition is not entertainable.

Admittedly, notice under Section 7 of the Tamil Nadu Land Encroachment Act was issued to the encroachers. Final notice under Section 6 also came to be issued. Aggrieved encroachers preferred an appeal under Section 10 of the Tamil Nadu Land Encroachment Act, which is pending before the District Collector, was also dismissed. That being the factum, the writ petition seeking the relief to forbear the respondents from interfering the petitioner’s possession is not maintainable. Thus, this writ petition stands dismissed. No costs.

Consequently, connected WMP is also closed.
