ORDER

The Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the second respondent to implement the order passed by the first respondent vide Ni.Mu.2354/2022/A4, dated 26.12.2023 and transfer the Patta in the petitioner's name in respect of the property comprised in S.No.20/5, situated at Vellala Viduthi Village and Post, Karambakudi Taluk, Pudukkottai District, on the basis of the petitioner's representation dated 11.11.2025, within the time stipulated by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the property comprised in S.No.20/5, measuring 0.02.5 Ares, situated at Vellala Viduthi Village, Karambakudi Taluk, Pudukkottai District, having derived title through a registered sale deed dated 17.06.1987 (Document No.626/1987) executed in favour of the petitioner’s grandfather, Subbaiah Velalar. After the demise of the petitioner’s grandfather and father, the petitioner succeeded to the property and has been in lawful possession and enjoyment thereof. While verifying the revenue records, the petitioner came to know that the name of one Murugiah Velalar had been erroneously entered as pattadar, without any legal basis. Upon the petitioner’s representation, the first respondent conducted a proper enquiry by issuing notice to the concerned parties and passed an order dated 26.12.2023 in Ni.Mu.2354/2022/A4. By the said order, the first respondent directed the second respondent/Tahsildar to cancel the patta standing in the name of Murugiah Velalar, restore the name of the original owner/vendor Kandasamy Velalar, effect subdivision based on the sale deed dated 17.06.1987, and consequently transfer the patta in favour of the petitioner. Thereafter, the second respondent did not take any action and therefore, the petitioner has approached this Court by way of filing the present Writ Petition.

4. The learned Government Advocate appearing for the respondents submits that the second respondent requires twelve weeks' time to pass appropriate orders in accordance with law.

Recording the above submissions, this Writ Petition is disposed of, with a direction to the second respondent to pass appropriate orders in accordance with law, after giving due opportunity to the petitioner and all other persons, who may be interested in the subject matter, within a period of twelve weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the second respondent to pass appropriate orders on merits and in accordance with law. There shall be no order as to costs.
